Covenants

  1. The lands shall be used for private residential purposes only.

  2. All buildings constructed on the property must have a minimum setback of 50 feet from the road and no buildings of any nature may be constructed within 25 feet of property boundary unless, in exceptional circumstances and in agreement with the developer and adjacent landowner to take advantage of the unique terrain.

  3. No living or viable healthy trees may be cut, killed or removed from within 25 feet of boundary lines between properties except when needed to allow for the construction of a dwelling or other building, to facilitate the development of lawns, gardens or coastal views from the parcel or for proper sustainable forest cleanup and maintenance. Clear-cutting of large areas shall not be permitted unless approved by the Developer.

  4. No refuse, building waste, car bodies, garbage or obnoxious and unsightly materials of any kind may be dumped or stored on the property. No incinerator or other refuse burning device may be built or maintained on the property. All trash and garbage shall be regularly removed from the property and not allowed to accumulate. All homeowners may be required to subscribe to a single trash pickup service.

  5. No lot may be divided into smaller parcels at any time. The intent of this restriction is to prevent the creation of smaller lots out of the original.

  6. No signs, billboards or advertising structures are permitted on any lot except temporary real estate signage.

  7. No animals other than the types of household pets normally permitted in private homes are allowed. No livestock or commercial breeding of animals is permitted. It is the responsibility of the owner to maintain and handle the pet in such a manner so as not to be offensive.

  8. All exterior lights must be located and designed in a manner which prevents glare and unreasonable interference with surrounding dwelling units and common areas.

  9. Each lot owner shall have their own well or other approved water source and each shall have a septic tank or other approved waste disposal system. All such systems must comply and be located in accordance with the rules and standards set forth by the Beaver Harbour municipality and the Province of New Brunswick.

  10. No excessive and/or incessant, disruptive noise is permitted such as, but not limited to, un-muffled motors, blaring music, loud unruly parties or constantly barking dogs.

  11. No property or any portion of a property may be used to permit access to any other lands. No right of way or right of use to any road or common area is transferable or assignable by the property owner to a third party. This clause is not intended to prevent a property owner from selling his land and all rights pertaining thereto to a purchaser, but the property owner is not entitled to reserve or retain any right or privilege in or to the lands at the time of his sale to another party.

  12. The Guarantee shall become a member of the Mariner's Reach Private Road Association Inc. and to maintain such membership during the ownership of the specified parcel, including payment of any and all assessments for the management and maintenance of the road, or until the road becomes a public road, whichever shall occur first.
